BRP LIMITED WARRANTY NORTH AMERICA: SYMPATEX RIDING GEAR

WARRANTY COVERAGE PERIOD
Bombardier Recreational Products Inc. (BRP) warrants that all its 2012 SympaTex® Riding Gear sold as New and Unused by an authorized North American BRP dealer will be free from any defect in material and / or workmanship for the lifetime of the product**.

WHAT BRP WILL DO?
BRP will repair if possible or replace all valid warranty item SympaTex® Riding Gear found defective in material and/or workmanship subjected to normal use, with original SympaTex® Riding Gear without charge, to any authorized Ski-Doo® dealer during the useful life of the product.

BRP will not be responsible for any settlement made between a dealer and a consumer unless settlement is within the guidelines of the BRP defect analysis charts. Furthermore, warranty claims are always subject to final approval by BRP.

CONDITIONS FOR COVERAGE
The consumer must notify an authorized Ski Doo® dealer within two (2) days of the appearance of the defect in material and/or workmanship and present to the authorized Ski Doo® dealer a proof of purchase (ORIGINAL BILL OF SALE) of the NEW and UNUSED SympaTex® riding gear. All items replaced under this limited warranty become the property of BRP. Please have all warranty items clean for evaluation or it will be returned to you without an inspection being made.

EXCLUSIONS ARE NOT WARRANTED
The BRP Limited Warranty does not apply to the following damages and costs:
• Normal wear and tear;
• Damage resulting from improper care and maintenance, as described on the care label of the garment;
• Damage resulting from abuse, misuse or neglect;
• Damage resulting from use in commercial applications;
• Damage resulting from modifications, alterations or use for a purpose other than which it was designed for;
• Damage resulting from accident, fire, theft, vandalism or any act of God;
• Incidental or consequential costs of any kind, including without limitation, telephone calls;

** The lifetime of a product doEs not mean your lifetime. The intensity under which the product is used determines this factor. Rips, tears, punctures, holes and burns will void the product lifetime warranty even if the warranty issue is not related to these damages.

LIMITATIONS OF LIABILITY
THIS WARRANTY IS EXPRESSLY GIVEN AND ACCEPTED IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT THAT THEY CANNOT BE DISCLAIMED, THE IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE LIFE OF THE EXPRESS WARRANTY. INCIDENTAL AND CONSEQUENTIAL DAMAGES ARE EXCLUDED FROM COVERAGE UNDER THIS WARRANTY. SOME STATES/ PROVINCES DO NOT ALLOW FOR THE DISCLAIMERS, LIMITATIONS AND EXCLUSIONS IDENTIFIED ABOVE, AS A RESULT, THEY MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC RIGHTS, AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH MAY VARY FROM STATE TO STATE, OR PROVINCE TO PROVINCE.

Neither the distributor, nor any BRP dealer or any other person has been authorized to make any affirmation, representation or warranty regarding the product, other than those contained in this limited warranty, and if made, shall not be enforceable against BRP.

BRP reserves the right to modify this warranty at any time, being understood that such modification will not alter the warranty conditions applicable to the products sold while this warranty is in effect.

CONSUMER ASSISTANCE
In the event of a controversy or a dispute in connection with this BRP LIMITED WARRANTY, BRP suggests that you try to resolve the issue at the dealership level. We recommend discussing the issue with the authorized BRP dealer's clothing manager or owner.
